Dismissed Drug Charges
Recently, the Westchester County criminal defense lawyers at
Riebling, Proto & Sachs, LLP with offices in White Plains had the criminal drug charges of
criminal possession of a controlled substance and criminal possession of marijuana dismissed inYonkers City Court.
The client was charged with possessing cocaine and marijuana during a traffic stop. After lengthy investigation, negotiations with the District Attorney's office and the Yonkers City Court Judges it was determined that the charges should be dismissed.
As criminal defense lawyers we investigate the unique facts about each of our client's cases and take advantage of all criminal defenses.
In the Yonkers matter the police arrested our client after a traffic stop and drugs were recovered after our client was taken into custody. Our criminal lawyers argued that although the drugs were found in the rear of the police car, with the client it, would be impossible for the client to bring drugs into the police car as the client was handcuffed at the time. The District Attorney argued that the drugs were located in the client's pocket and the client must have dropped the drugs in the rear seat of the police vehicle. Although the District Attorney's theory was plausible the police said that the client was searched before the client was placed into the rear of the police vehicle. Our final arguments were that the illegal drugs must have already been in the rear seat of the police vehicle before the client entered the vehicle. This was the more reasonable theory and best criminal defense.
The criminal defense assessment
Our criminal defense lawyers look at every criminal case from the perspective of what exactly can the District Attorney's office prove. The government must prove every element of the charge, beyond a reasonable doubt, and if they are unable to do so the criminal charge must be dismissed.
If the District Attorney has a strong case our criminal defense attorneys investigate and argue violations of our client's constitutional rights to weaken the prosecution's case. Our criminal lawyers will also ask our clients for character letters from friends/family and other supporting documentation to support our client's personal character.
The most important part of our defense strategy is keeping in touch with our clients. We schedule meetings, telephone calls and interview witnesses to develop the best possible legal strategy. Our clients are always informed about the progress of their case and possible resolutions. Our client's always know what is going on with their case and how the defense is proceeding.
