Assault 3rd Degree Charge Dismissed in the Ossining Town Court
assault defense is to prepare a legal strategy that reviews all the evidence of
the case and the District Attorney's ability to prove the case beyond
a reasonable doubt. The best
criminal defense lawyers always challenge the prosecution and aggressively pursue all defenses.
Recently, in Westchester County, Town of Ossining Court, the criminal defense
Riebling, Proto & Sachs, LLP successfully had assault charges dismissed just before trial as our lawyers
determined that the prosecution could not prove the case.
In this matter our client was charged with a
domestic violence assault charge and our investigation prior to trial determined that a
key piece of evidence was missing in the prosecution's case. Our assault
lawyers negotiated with the district attorney's office but they were
unwilling to withdraw the case. Our client was tempted with a favorable
plea bargain offer but after several legal strategy meetings our client
was confident we would be successful making an application directly to
the Ossining Court for dismissal.
On the day of trial, during a conference with the judge, the District Attorney's
office admitted that they would have great difficultly proving the case
and our assault lawyers aggressively argued to the Judge for a dismissal.
Based upon our arguments the judge agreed that the case had to be dismissed.
As a result of the dismissal the charge of
misdemeanor assault in the 3rd degree was dismissed, sealed, the temporary order of protection was dismissed,
and the bail posted was returned to our client.
Our law firm has an office in White Plains, New York and our attorneys
regularly appear throughout the courts of Westchester, Putnam, Dutchess,
Rockland counties and in the Bronx. Our criminal defense lawyers are former
prosecutors that always work hard to protect our client's rights.
We are familiar with the District Attorney's strategies and potential
weaknesses in their cases and we use that knowledge and experience to
help our clients when charged with any crime.
