I have been invited to a pre trial conference with the Asst DA. This is new for me. I am a non attorney but have a lot of experience(too much) in negotiating deals and getting dismissals.
Question: if a DA is handling the case, does the officer need to show up for a trial?
Thanks

Update on Blog --

People v Rathgeber, 2009 NY Slip Op 50653U

Town of Bedford Justice Court

The Appellate Court held that where a prior simplified traffic information was dismissed for failure to serve a requested supporting deposition, absent special circumstances warranting a re-filed accustory instrument would reconstitute an improvident exercise of discretion since it would defeat the very purpose of CPL 100.40(2), disregard the intrest of judical economy and erode the confidence of the public in the criminal justice system.
