Drunk Driving License Implications

Driver's License Implications for Various Offenses

If you are facing alcohol or drug related violations, it is important to know that your driver's license may be in jeopardy. Whether you need your driver's license to drive to and from work, or you are a truck driver who depends on your commercial driver's license (CDL) for your livelihood, contact our office to discuss how we can help.

Our staff at The Law Offices of Riebling, Proto & Sachs, LLP is dedicated to aggressively fighting for your rights and striving to see that you retain your license. Driver's license suspensions and revocations are handled in different ways. With the help of knowledgeable attorney Dave Sachs, you can begin to understand the processes through which license implications are enforced. We can discuss your options if your driver's license is revoked or suspended.

Conviction on a DWI or DWAI charge will result in a mandatory suspension or revocation of your driving privileges. The length of the suspension or revocation is determined by whether you are convicted of DWI or DWAI and can last as much as eighteen months.

Driver's License Suspension

When your license is suspended, which usually occurs at your first court appearance, your driving privileges are lost for a set period of time. At the end of this specified amount of time, your license is automatically reinstated with no further review of the driver's license. If you are found guilty of a DWAI or plead guilty to a DWAI as a violation and not a crime, your license will be suspended for 90 days.

Driver's License Revocation

If your driver's license is revoked, it means that your license is effectively cancelled. Your driving record and license are scrutinized and a thorough review is completed before you can get your license back. Unlike a suspension, there is not an automatic reinstatement of the license. If you pled guilty or are found guilty of a misdemeanor DWI then your drivers license will be revoked for at least six months. If you are found guilty of a felony DWI or plead guilty to a felony DWI then your driver's license will be revoked for no less than one year.
