Criminal Mischief

ALL charges withdrawn by the District Attorney's Office

The top criminal defense lawyers know that to successfully defend a criminal case there must be a sound legal strategy to zealously represent the client and keep pressure on the District Attorney's office. Recently, in the Town of Fallsburgh, New York, the Westchester County Criminal Defense attorneys from the law firm of Proto, Sachs & Brown, LLP convinced the District Attorney's Office to withdraw three class "A" misdemeanor charges pending against their client.

All the charges stemmed from a domestic dispute during a custody battle in the New York State Family Court. The parties had an ongoing custody dispute that resulted in our client's arrest on the criminal charges of Assault, Endangering the Welfare of a Child and Criminal Mischief. These are three serious misdemeanor charges that can result in up to a year in jail on each, three years of probation, CPS investigations, loss of professional licenses and could be used against the accused (our client) in Family Court.

It was our legal strategy to quickly resolve the criminal matters as it was clear to us and our client that the father filed criminal charges against the mother to gain leverage in the custody litigation. Our client had several professional licenses and could not risk a conviction for any criminal offense.

After repeated conversations with the District Attorney's office, both the criminal court lawyers and family court lawyers from our law office were able to convince the District Attorney to withdraw all charges. This opened the door for a more aggressive legal strategy in the custody litigation.

At the law office of Proto, Sachs & Brown, LLP our attorney's main focus of practice includes the areas of criminal defense, family law and divorce.
