What are the different types of Custody in New York?
This is a question that our clients often ask when they are faced with

Physical Custody simply refers to the place where the child lives. The
physical custodian is the parent with whom the child has their legal residence.
Physical Custody is different from Legal Custody which refers to the right
of a parent to make decision on behalf of the child. Typically, this means
decisions involving the child's medical care, religion and education.
Legal Custody and Physical Custody may be Joint (where the parents share
in the decision making or divide time equally) or Sole (where one parent
is responsible for making the decisions on their own).
