Relocation & Custody Case in Yonkers Family Court
Recently, a client of
Riebling, Proto & Sachs presented with a shocking custody/relocation case. In that matter the
child was living with the father when the mother, under the guise of a
weeklong trip, relocated with the child to an unknown location in the
State of Texas. The father found out the mother had no intention of returning
to New York and had enrolled the child in school in Texas. The father
immediately contacted our office for help. We quickly developed a legal
strategy to have the child returned to the father in New York.
Within hours we had the necessary petitions filed with the Yonkers Family
Court in Westchester County to have the child returned to New York and
for the father to have full custody. The Yonkers Family Court Judge Ordered
the parents and the child to the Yonkers Family Court days later.
In court, the mother's only strategy was to make allegations of domestic
violence and physical abuse against the child as her reason for leaving
New York. After arguments before the judge it was clear that none of these
allegations could be substantiated. Our top custody/relocation lawyers
argued to the judge that this was an attempt by the mother to justify
her actions and obtain custody but her claims were not credible without
a shred of proof.
After lengthy arguments the child was returned the father and properly
enrolled in school in Yonkers. It was clear that the mother could reside
wherever she wanted but she was not going to be able to take the child
with her as the father had custodial and parental rights.
This case could have had an entirely different outcome if the father did
not act quickly to establish his parental rights. It is always advisable
