How Your Immigration Status Could Affect Your Criminal Case

Criminal Defense and Immigration Status

As criminal defense lawyers in Westchester County, New York we always ask about our client's immigration status in the United States. Every top criminal defense lawyer knows that an accused's immigration status can not be overlooked.

Those who are not US citizens at the time of an arrest may face an immigration hold (ICE Hold) while the case is pending or deportation after a conviction. It is very import for an accused to know exactly what the immigration consequences are for any criminal charge and hire a top criminal defense attorney to defend against the criminal charges.

The most common charges that can lead to deportation are:

The criminal defense of immigrants and non-citizens

It is never advisable for anyone to walk into criminal court without a lawyer.

Our experience working with immigrants and non-citizens

Our attorneys have over 50 years of combined experience defending clients throughout Westchester, Putnam, Dutchess, Rockland, Orange County, and the Bronx in all types of criminal matters. When immigration consequences are at issue we take great care to protect our clients from potential immigration consequences, such as deportation.

13 Year Old Port Chester Conviction Opened

Recently our law office opened a 13 year old guilty plea in the Westchester County, Port Chester Village Court because the old marijuana conviction was preventing our client from obtaining citizenship. 13 years ago our client walked into the Post Chester Court and entered a guilty plea without a lawyer or knowledge of the immigration consequences of a guilty plea. That guilty plea was preventing our client from obtaining citizenship.

Our criminal defense lawyers made motions, argued with the District Attorney's Office and finally convinced the judge that the conviction should be opened. We were ultimately able to resolve our client's case to remove the marijuana conviction paving the way for our client's citizenship.

Petit Larceny Charge Dismissed

Our client was charged with petit larceny in the Town of Southeast Court, Putnam County. The accused hired our law office and we determined that the conviction would result in deportation. The only option for the client was a dismissal.

After lengthy arguments with the District Attorney and the Judge it was agreed that the charge should be dismissed. This was critical as a conviction for petit larceny or a plea bargain to a reduced charge would have likely resulted in immediate deportation.

Drug Charge Dismissed

In the Mount Kisco Justice Court, Westchester County our client was charged with serious drug related offenses that would clearly result in an ICE Hold or deportation. Once again our lawyers had the charges dismissed so the client could avoid any immigration consequences.

Drug Charge Reduced

In the White Plains City Court in Westchester County our law office successfully had a drug possession case reduced to thereby avoiding immigration consequences for the client.
