Not Guilty Verdict - Westchester County Assault Case

Our client had been charged in a domestic violence case with assault in the third degree a misdemeanor in New York State. The case orginated in New Rochelle City Court and our client was looking for a New Rochelle criminal defense lawyer. From the beginning the firm arranged for our clients release from jail and appeared by our client’s side at each and every Court appearance in New Rochelle and after the case had been transferred to the Integrated Domestic Violence (IDV) Court in White Plains.
Through extensive plea bargain negotiations with the Westchester County District Attorney’s Office we were able to obtain a reduction plea offer from the crime of assault to the non-criminal offense of harassment. Our client rejected the plea bargain offer. We stressed to the judge our client was innocent and the matter proceeded to a jury trial.
The allegations were that our client had hit his wife in the head with a headboard while she was sleeping resulting in a concussion, partial blindness and headaches. At trial the defense included that there was no objective evidence of a concussion or any injury and that the wife was motivated to lie as she had applied for a domestic violence green using this incident to push through her citizenship application.
The jury deliberated for over a day and reached a not guilty verdict on all counts.
