Peekskill, NY -- A college student charged with Criminal Possession of Marijuana in the 4th degree, the “A” Misdemeanor, was represented by David Sachs, Esq. of the Westchester County Law Firm of Proto, Sachs & Brown, LLP resulting in a dismissal of the criminal charges after a 1 day Adjournment in Contemplation of Dismissal (ACD).
Initially the prosecution took a firm position on the case demanding a plea of guilty to the Misdemeanor charge with a probationary sentence. The prosecution argued that the client was a drug dealer due to the large amount of money found in his dorm room, several scales, bags and his admission he has sold marijuana.
Attorney Sachs argued that his client was a good student, father, was positively active within his community, employed and, due to this incident, voluntarily removed himself from the college. The client also had excellent reference letters from the college community. One of the concerns for the client and Attorney Sachs was that any marijuana conviction would result in a loss and ineligibility for federal financial aid.
At first the prosecution demanded a plea of guilty to the misdemeanor with three years of probation. However, through legal argument and an accurate presentation of his the client, Attorney Sachs persuaded the prosecution to revise their position. After the prosecution revised their demand to a non-criminal conviction with no probation conditioned on 70 hours of community service Attorney Sachs successfully argued for a further reduction to a dismissal of the case to a 1 day ACD and no community service.
Afterwards the client was very happy with the aggressive approach and ultimate dismissal of the criminal charge.
