Avoiding Points on Your Driver's License

The New York Department of Motor Vehicles (DMV) has instituted a points system which assigns a specific number of points to traffic violations depending on their severity. Once a driver accumulates 11 points, their license may be suspended or revoked. Driving privileges may also be revoked if a driver has three speeding convictions within an 18-month period. Points remain on a driving record from the date of the violation for 18 months. The number of points on a driving record has a direct impact on insurance rates.

Speeding

  • 1-10 MPH over limit: 3 Points
  • 11-20 MPH over limit: 4 Points
  • 21-30 MPH over limit: 6 Points
  • 31-40 MPH over limit: 8 Points
  • 40 + MPH over limit: 11 Points

Cell Phone

  • 5 Points

Texting While Driving

  • 5 Points

Improper passing

  • 3 Points

Unsafe lane change

  • 3 Points

Failure to obey traffic signal, stop sign or yield sign

  • 3 Points

Failure to yield right-of-way

  • 3 Points

Railroad crossing violation

  • 3 Points

Passenger safety violation, including seat belt violations

  • 3 Points

Leaving the scene of an accident that resulted in property damage or domestic animal injury

  • 3 Points

Inadequate brakes

  • 4 Points

Following too closely

  • 4 Points

Failure to stop for a school bus
